Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 15.2-2288.8 as follows:
§15.2-2288.8. Special use permit may not be required for certain freestanding medical facilities.
A. No ordinance of a city whose governing body appoints all of the members of a hospital authority shall require that a special exception, special use, or conditional use permit be obtained for the development and construction of a freestanding medical facility on property where such use is permitted by right under the local zoning ordinance.
B. As used in this section:
"Freestanding medical facility" means a facility that only provides outpatient medical services, operates as a department of a hospital, and is located off the main campus of a hospital.
"Hospital authority" means a public body politic and corporate created by act of assembly and whose powers include to provide or assist in providing medical care and related services in its service area. "Hospital authority" shall not mean an authority created pursuant to Chapter 53 (§15.2-5300 et seq.).
