A BILL to amend the Code of Virginia by adding a section numbered 2.2-510.01, relating to the Office of Attorney General; mandatory employment of special counsel for the State Board of Elections under certain circumstances.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 2.2-510.01 as follows:

§2.2-510.01. Mandatory employment of special counsel under certain circumstances; State Board of Elections.

Whenever the Attorney General is a candidate who is entitled to have his name printed on the ballot, pursuant to § 24.2-504 in a general or special election, he shall recuse himself from providing legal services to the State Board of Elections and employ special counsel to provide such services. The compensation for the special counsel shall be paid out of the appropriation for the Attorney General's office.
