A BILL to amend the Code of Virginia by adding a section numbered 16.1-274.2, relating to certain statements from students; admissibility.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 16.1-274.2 as follows:

§16.1-274.2. Certain statements by current or former student inadmissible.

Where an individual who is a current or former student of any elementary, middle, or secondary school is alleged to have committed a delinquent act while a student at such school, no oral or written statement made by the student as a result of an interview, interrogation, or questioning by a school employee shall be admissible as evidence against the student in any adjudication of delinquency proceeding unless the student's parent, guardian, or legal custodian was present at the time such oral statement or writing was made.
