A BILL to amend the Code of Virginia by adding a section numbered 55-50.1:1, relating to rights of ingress and egress; use of former rail spur track easement; continuation or reinstatement of rights and benefits.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 55-50.1:1 as follows:

§55-50.1:1. Rights of ingress and egress; use of former rail spur track easement; continuation or reinstatement of rights and benefits.

A. For the purposes of this section, "rail spur track" means a short branch rail track leading from the main rail track that is connected with such main rail track at only one end of such main rail track.

B. Where a nonexclusive right of ingress and egress for the use of a rail spur track is created on and over a servient estate for access to loading docks at the rear of a building on a dominant estate for the loading and unloading of vehicles and for purposes incidental to such loading and unloading, including the parking of vehicles while engaged in such loading and unloading, such rights and benefits associated with such dominant easement, shall continue, or be reinstated, as necessary, even if such rail spur track has been abandoned or use of such rail spur track has been discontinued.
