Be it enacted by the General Assembly of Virginia:

1.  That the Code of Virginia is amended by adding a section numbered 18.2-386.2 as follows:

§18.2-386.2. Civil relief for victims of unlawful filming; damages.

A. Any person who was a victim of an offense under §18.2-386.1 may bring an action against the offender, regardless of whether the offender was convicted for the offense, and may recover an award of $150,000 per offense or actual damages sustained, whichever is greater, together with costs and reasonable attorney fees.

B. For purposes of this section, damages include damages for personal injury, emotional injury, and pain and suffering.
