A BILL to amend the Code of Virginia by adding in Article 2.1 of Chapter 4 of Title 32.1 a section numbered 32.1-111.15:2 and by adding a section numbered 32.1-137.09:1, relating to emergency medical services; hospitals; mandatory reporting of controlled substance overdoses.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding in Article 2.1 of Chapter 4 of Title 32.1 a section numbered 32.1-111.15:2 and by adding a section numbered 32.1-137.09:1 as follows:

§32.1-111.15:2. Reporting of controlled substance overdoses.

Every EMS agency or EMS provider that treats and releases a person in response to a suspected or actual overdose of a controlled substance shall report such incident to the Department within 120 hours. The Department shall transfer data on such reports to the Washington/Baltimore High Intensity Drug Trafficking Area's Overdose Detection Mapping Application Program or other appropriate program with secure access identified by the Department.

§32.1-137.09:1. Reporting of controlled substance overdoses.

Every hospital that treats and releases a person in response to a suspected or actual overdose of a controlled substance may report such incident to the Department within 120 hours. The Department shall transfer data on such reports to the Washington/Baltimore High Intensity Drug Trafficking Area's Overdose Detection Mapping Application Program or other appropriate program with secure access identified by the Department if information on the data, time, and location of such incidents is available.
