A BILL to amend the Code of Virginia by adding a section numbered 22.1-287.01, relating to student information; release to federal government agencies.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding in Article 5 of Chapter 14 of Title 22.1 a section numbered 22.1-287.01 as follows:

§22.1-287.01. Student information; release to federal government agencies.

No member or employee of a local school board or the Board of Education shall transmit personally identifiable information, as that term is defined in the Family Educational Rights and Privacy Act (20 U.S.C. §1232g) and related regulations, from a student's record to a federal government agency or an authorized representative of such agency for purposes permitted by local, state, or federal law unless the member or employee first notifies the student's parent and provides the parent with the opportunity to opt out of the transmission.
