Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 10.1-1184.1 as follows:
§10.1-1184.1. Regional emissions compacts; condition for participation.
Notwithstanding any other provision of law, neither the Governor, the State Air Pollution Control Board, the Department, any other state agency, nor any political subdivision of the Commonwealth shall adopt any regulation, rule, or guidance document that establishes or authorizes the Commonwealth to join or participate in a regional or multistate program addressing carbon dioxide, greenhouse gas, or other emissions from the electric utility sector or transportation sector unless the program (i) provides for the trade, sale, or purchase of emissions allowances or their equivalent and (ii) requires that all of the proceeds from the sale of emissions allowances or their equivalent be returned to customers in the Commonwealth in an amount that is reasonably related to the proportionate share of the costs that are paid by the customer, which in the case of a program addressing (a) the electric utility sector, such customers are the metered customers of an electric utility that is required to pay for the emissions allowances or their equivalent and (b) the transportation sector, such customers are persons who purchase gasoline or diesel fuel or vehicle emissions reduction devices.
