Summary

Virginia Consumer Protection Act; defective drywall; penalties. Makes it a prohibited practice under the Virginia Consumer Protection Act for a supplier to sell, offer for sale, or use in the construction, remodeling, or repair of any residential dwelling in Virginia, any drywall that he knows or has reason to know is drywall that, as a result of containing the same or greater levels of strontium sulfide that has been found in drywall manufactured in China and imported between 2004 and 2007, is capable of releasing sulfur compounds into the air. Such a sale, offering or use of drywall that has been designated by the Consumer Product Safety Commission as posing a substantial product hazard is also made a prohibited practice under the Virginia Consumer Protection Act. The prohibition does not apply to the sale or offering for sale of any building or structure in which such drywall has been permanently installed or affixed. The measure applies to transactions occurring on or after the effective date of the measure, which will become effective upon enactment pursuant to an emergency clause.
