relating to the issuance of an occupational license to certain | ||
applicants with prior convictions. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 53.0211(b), Occupations Code, is amended | ||
to read as follows: | ||
(b) Notwithstanding any law other than Subsection (a) and | ||
unless the applicant has been convicted of an offense described by | ||
Section 53.021(a)(1), (3), or (4), or an offense described by | ||
Section 53.021(a)(2) that is punishable as a felony [ |
||
licensing authority shall issue to an otherwise qualified applicant | ||
who has been convicted of an offense: | ||
(1) the license for which the applicant applied; or | ||
(2) a provisional license described by Subsection (c). | ||
SECTION 2. The change in law made by this Act applies only | ||
to an application for a license submitted on or after the effective | ||
date of this Act. An application for a license submitted before the | ||
effective date of this Act is governed by the law in effect on the | ||
date the application was submitted, and the former law is continued | ||
in effect for that purpose. | ||
SECTION 3. This Act takes effect September 1, 2019. |
