A BILL TO BE ENTITLED
 
AN ACT
  relating to the authority of a physician to supervise or delegate
  the prescribing or ordering of a drug or device to a physician
  assistant or advanced practice registered nurse.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 157.0511, Occupations Code, is amended
  by adding Subsection (d) to read as follows:
         (d)  A physician may not supervise or delegate the
  prescribing or ordering of a drug or device under this subchapter to
  a physician assistant or advanced practice registered nurse who
  practices in a medical specialty outside the scope of the
  physician's residency training or primary medical practice, unless
  the physician has not less than five years of previous practice
  experience in that specialty.
         SECTION 2.  This Act takes effect September 1, 2023.
