A BILL TO BE ENTITLED
 
AN ACT
 
  relating to the eligibility of public institutions of higher
  education for formula funding for health-related institutions.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter C, Chapter 61, Education Code, is
  amended by adding Section 61.0591 to read as follows:
         Sec. 61.0591.  ELIGIBILITY FOR CERTAIN FORMULA FUNDING. An
  institution of higher education created on or after January 1,
  2017, is eligible for formula funding under formulas established
  for health-related institutions under Section 61.059 only if a
  statute:
               (1)  created or authorized creation of the particular
  institution; or
               (2)  expressly provides that the particular
  institution is eligible for that formula funding.
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2017.
