relating to provision by the secretary of state of notice to a | ||
candidate of the form of the candidate's name that will appear on | ||
the general election ballot. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 161.008, Election Code, is amended by | ||
adding Subsection (d) to read as follows: | ||
(d) Not later than the 30th day before the date the | ||
secretary of state makes a certification under this section, the | ||
secretary of state shall provide notice by certified mail, return | ||
receipt requested, to each candidate to be included in the | ||
certification. The notice must: | ||
(1) contain the exact form for which the candidate's | ||
name will be certified for placement on the ballot; and | ||
(2) provide information to the candidate on how errors | ||
in the form of the candidate's name may be corrected. | ||
SECTION 2. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect September 1, 2011. |
