| relating to provision by the secretary of state of notice to a | ||
| candidate of the form of the candidate's name that will appear on | ||
| the general election ballot. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 161.008, Election Code, is amended by | ||
| adding Subsection (d) to read as follows: | ||
| (d) Not later than the 30th day before the date the | ||
| secretary of state makes a certification under this section, the | ||
| secretary of state shall provide notice by e-mail to each candidate | ||
| to be included in the certification who has provided an e-mail | ||
| address for that purpose. The notice must: | ||
| (1) contain the exact form for which the candidate's | ||
| name will be certified for placement on the ballot; and | ||
| (2) provide information to the candidate on how errors | ||
| in the form of the candidate's name may be corrected. | ||
| SECTION 2. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2011. | ||
