A BILL TO BE ENTITLED
 
AN ACT
  relating to best management practices for aggregate production
  operations.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  The heading to Chapter 28A, Water Code, is
  amended to read as follows:
  CHAPTER 28A.  REGULATION [REGISTRATION AND INSPECTION] OF CERTAIN
  AGGREGATE PRODUCTION OPERATIONS
         SECTION 2.  The heading to Subchapter B, Chapter 28A, Water
  Code, is amended to read as follows:
  SUBCHAPTER B.  REGISTRATION, [AND] INSPECTION, AND BEST PRACTICES
         SECTION 3.  Subchapter B, Chapter 28A, Water Code, is
  amended by adding Section 28A.055 to read as follows:
         Sec. 28A.055.  BEST MANAGEMENT PRACTICES. The commission
  shall adopt and make accessible on the commission's Internet
  website best management practices for aggregate production
  operations to comply with applicable environmental laws and rules.
         SECTION 4.  As soon as practicable after the effective date
  of this Act, the Texas Commission on Environmental Quality shall
  adopt the best management practices required under Section 28A.055,
  Water Code, as added by this Act.
         SECTION 5.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2021.
