relating to penalties imposed on a holder of an alcoholic beverage | ||

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 11.641, Alcoholic Beverage Code, is | ||
amended by adding Subsection (d) to read as follows: | ||
(d) Notwithstanding (c), the commission may seek to impose | ||
an administrative sanction against a permit or license holder when | ||
the administrative sanction arises from the same facts or | ||
circumstances as a criminal prosecution, so long as the sanction is | ||
not dependent on a finding of guilt for the commission of a criminal | ||
offense. | ||
SECTION 2. Section 11.641, Alcoholic Beverage Code, as | ||
amended by this Act, applies only to the imposition of an | ||
administrative sanction for a violation that occurs on or after the | ||
effective date of this Act. The imposition of a civil penalty, | ||
including cancellation of a permit, for a violation that occurs | ||
before the effective date of this Act is governed by the law in | ||
effect immediately before the effective date of this Act, and that | ||
law is continued in effect for that purpose. | ||
SECTION 3. This Act takes effect September 1, 2017. |
