A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to penalties imposed on a holder of an alcoholic beverage |
|
|
license or permit. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 11.641, Alcoholic Beverage Code, is |
|
|
amended by adding Subsection (d) to read as follows: |
|
|
(d) Notwithstanding (c), the commission may seek to impose |
|
|
an administrative sanction against a permit or license holder when |
|
|
the administrative sanction arises from the same facts or |
|
|
circumstances as a criminal prosecution, so long as the sanction is |
|
|
not dependent on a finding of guilt for the commission of a criminal |
|
|
offense. |
|
|
SECTION 2. Section 11.641, Alcoholic Beverage Code, as |
|
|
amended by this Act, applies only to the imposition of an |
|
|
administrative sanction for a violation that occurs on or after the |
|
|
effective date of this Act. The imposition of a civil penalty, |
|
|
including cancellation of a permit, for a violation that occurs |
|
|
before the effective date of this Act is governed by the law in |
|
|
effect immediately before the effective date of this Act, and that |
|
|
law is continued in effect for that purpose. |
|
|
SECTION 3. This Act takes effect September 1, 2017. |
