relating to prohibiting the sale or release of personal identifying | ||
information by a state governmental body. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Chapter 559, Government Code, is amended by | ||
adding Section 559.006 to read as follows: | ||
Sec. 559.006. PROHIBITED SALE OR RELEASE OF PERSONAL | ||
IDENTIFYING INFORMATION. A state governmental body may not sell or | ||
release an individual's personal identifying information, as | ||
defined by Section 521.002, Business & Commerce Code, to a person | ||
who does not work for the state governmental body without the | ||
written consent of the individual unless the information: | ||
(1) must be released in order for the state | ||
governmental body to provide a service the state governmental body | ||
is authorized by law to provide; | ||
(2) is the subject of a pending request for | ||
information made under Chapter 552 or other law; or | ||
(3) is relevant to an investigation or an official | ||
proceeding that is pending or is in progress. | ||
SECTION 2. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect September 1, 2013. |
