A BILL TO BE ENTITLED
 
AN ACT
  relating to prohibiting the sale or release of personal identifying
  information by a state governmental body.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Chapter 559, Government Code, is amended by
  adding Section 559.006 to read as follows:
         Sec. 559.006.  PROHIBITED SALE OR RELEASE OF PERSONAL
  IDENTIFYING INFORMATION. A state governmental body may not sell or
  release an individual's personal identifying information, as
  defined by Section 521.002, Business & Commerce Code, to a person
  who does not work for the state governmental body without the
  written consent of the individual unless the information:
               (1)  must be released in order for the state
  governmental body to provide a service the state governmental body
  is authorized by law to provide;
               (2)  is the subject of a pending request for
  information made under Chapter 552 or other law; or
               (3)  is relevant to an investigation or an official
  proceeding that is pending or is in progress.
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2013.
