relating to unemployment compensation chargebacks regarding | ||
certain persons employed as seasonal employees. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 204.022, Labor Code, is amended by | ||
adding Subsection (a-3) to read as follows: | ||
(a-3) Benefits computed on benefit wage credits of a | ||
seasonal employee or former seasonal employee may not be charged to | ||
the account of an employer if at least 75 percent of the employees | ||
employed by the employer during each of the most recent three | ||
calendar years were employed as seasonal employees. In this | ||
subsection, "seasonal employee" means an employee who, as a regular | ||
course of the employee's conduct, engages in seasonal or cyclical | ||
employment that does not continue throughout the entire year. | ||
SECTION 2. The change in law made by this Act applies only | ||
to a claim for unemployment compensation benefits filed with the | ||
Texas Workforce Commission on or after the effective date of this | ||
Act. A claim filed before the effective date of this Act is | ||
governed by the law in effect on the date the claim was filed, and | ||
the former law is continued in effect for that purpose. | ||
SECTION 3. This Act takes effect October 1, 2021. |
