A BILL TO BE ENTITLED
 
AN ACT
  relating to the procedures for the placement of children by certain
  governmental agencies.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter A, Chapter 262, Family Code, is
  amended by adding Section 262.011 to read as follows:
         Sec. 262.011.  POSSESSION OF CHILD BY FEDERAL AGENCY. (a) A
  federal governmental agency that takes possession of a child may
  not place the child with a person who is not the child's parent
  unless the child has been appointed an attorney ad litem and a
  guardian ad litem and a court of this state has determined that the
  placement is in the best interest of the child.
         (b)  The state shall seek reimbursement from the federal
  governmental agency for the costs incurred by the state relating to
  the appointment of the attorney ad litem and guardian ad litem and
  the court hearing.
         SECTION 2.  This Act takes effect September 1, 2013.
