relating to the procedures for the placement of children by certain | ||
governmental agencies. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subchapter A, Chapter 262, Family Code, is | ||
amended by adding Section 262.011 to read as follows: | ||
Sec. 262.011. POSSESSION OF CHILD BY FEDERAL AGENCY. (a) A | ||
federal governmental agency that takes possession of a child may | ||
not place the child with a person who is not the child's parent | ||
unless the child has been appointed an attorney ad litem and a | ||
guardian ad litem and a court of this state has determined that the | ||
placement is in the best interest of the child. | ||
(b) The state shall seek reimbursement from the federal | ||
governmental agency for the costs incurred by the state relating to | ||
the appointment of the attorney ad litem and guardian ad litem and | ||
the court hearing. | ||
SECTION 2. This Act takes effect September 1, 2013. |
