relating to businesses' civil liability for COVID-19 exposure. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Title 4, Civil Practice and Remedies Code, is | ||
amended by adding Chapter 100C to read as follows: | ||
CHAPTER 100C. COVID-19 EXPOSURE LIABILITY FOR BUSINESSES | ||
Sec. 100C.001. LIABILITY LIMITED. A business entity or | ||
person who owns a business entity may not be held liable for injury | ||
or death caused by exposure to the 2019 novel coronavirus disease | ||
that occurred due to the entity's activities or operations, unless | ||
a claimant proves that the exposure was caused by gross negligence | ||
or wilful misconduct. | ||
SECTION 2. Chapter 100C, Civil Practice and Remedies Code, | ||
as added by this Act, applies to a cause of action that accrued | ||
before, on, or after the effective date of this Act. | ||
SECTION 3. This Act takes effect September 1, 2021. |
