relating to mandatory supervision for certain offenses involving | ||
the possession of a controlled substance. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subchapter E, Chapter 508, Government Code, is | ||
amended by adding Section 508.1491 to read as follows: | ||
Sec. 508.1491. MANDATORY SUPERVISION FOR CERTAIN OFFENSES | ||
INVOLVING POSSESSION OF CONTROLLED SUBSTANCE. Sections | ||
508.149(b), (c), and (d) do not apply to an inmate who: | ||
(1) is serving a sentence for a third degree felony | ||
offense under Section 481.115, 481.1151, 481.116, 481.1161, | ||
481.117, 481.118, or 481.121, Health and Safety Code; | ||
(2) is described by Section 498.003(b)(1) or (2); and | ||
(3) has not been previously convicted of: | ||
(A) an offense for which registration as a sex | ||
offender is required under Chapter 62, Code of Criminal Procedure; | ||
or | ||
(B) an offense under Title 5, Penal Code. | ||
SECTION 2. The change in law made by this Act applies to any | ||
inmate serving a term of imprisonment in a facility operated by or | ||
under contract with the Texas Department of Criminal Justice on or | ||
after the effective date of this Act, regardless of when the inmate | ||
was sentenced to serve that term. | ||
SECTION 3. This Act takes effect September 1, 2015. |
