A BILL TO BE ENTITLED
 
AN ACT
  relating to the administration of certain immunizations or
  vaccinations by a pharmacist.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 554.052(c-1), Occupations Code, is
  amended to read as follows:
         (c-1)  A pharmacist may administer an influenza vaccination
  to a patient over seven years of age without an established
  physician-patient relationship. A pharmacist may administer a
  vaccination or immunization required by statute or rule to attend a
  middle or junior high school to a patient who is entering or
  attending middle or junior high school without establishing a
  physician-patient relationship.
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2011.
