| relating to the administration of certain immunizations or | ||
| vaccinations by a pharmacist. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 554.052(c-1), Occupations Code, is | ||
| amended to read as follows: | ||
| (c-1) A pharmacist may administer an influenza vaccination | ||
| to a patient over seven years of age without an established | ||
| physician-patient relationship. A pharmacist may administer a | ||
| vaccination or immunization required by statute or rule to attend a | ||
| middle or junior high school to a patient who is entering or | ||
| attending middle or junior high school without establishing a | ||
| physician-patient relationship. | ||
| SECTION 2. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2011. | ||
