| relating to retirees of the Teacher Retirement System of Texas who | ||
| resume certain employment with a school district. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 825.4092(e), Government Code, is amended | ||
| to read as follows: | ||
| (e) The amounts required to be paid under Subsections (b) | ||
| and (c) are not required to be paid by a reporting employer for a | ||
| retiree who retired from the retirement system: | ||
| (1) before September 1, 2005; or | ||
| (2) on or after September 1, 2005, if the retiree is | ||
| employed by a school district experiencing a teacher shortage, as | ||
| determined by the Texas Education Agency. | ||
| SECTION 2. The changes in law made by this Act apply to a | ||
| retiree of the Teacher Retirement System of Texas regardless of | ||
| whether the person retired from employment before, on, or after the | ||
| effective date of this Act. | ||
| SECTION 3. The changes in law made by this Act apply | ||
| beginning with the 2023-2024 school year. | ||
| SECTION 4. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2023. | ||
