BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 271.905(a), Local Government Code, is | ||
amended to read as follows: | ||
(a) In this section, "local government" means a | ||
municipality [ |

authorized under this title to purchase real property or personal | ||
property that is not affixed to real property. The term does not | ||
include a school district. | ||
SECTION 2. Section 271.9051(a), Local Government Code, is | ||
amended to read as follows: | ||
(a) This section applies only to a municipality [ |
||
|
||
title to purchase real property or personal property that is not | ||
affixed to real property. | ||
SECTION 3. The changes in law made by this Act apply only to | ||
a contract for which the initial notice soliciting bids is given on | ||
or after the effective date of this Act. A contract for which the | ||
initial notice soliciting bids is given before that date is | ||
governed by the law in effect when the initial notice is given, and | ||
the former law is continued in effect for that purpose. | ||
SECTION 4. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect September 1, 2011. | ||
