AN ACT
|
|
relating to local governments that may consider a bidder's |
|
principal place of business when awarding a contract. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 271.905(a), Local Government Code, is |
|
amended to read as follows: |
|
(a) In this section, "local government" means a |
|
municipality [with a population of 200,000 or less], a county [with
|
|
a population of 400,000 or less], or another political subdivision |
|
authorized under this title to purchase real property or personal |
|
property that is not affixed to real property. The term does not |
|
include a school district. |
|
SECTION 2. Section 271.9051(a), Local Government Code, is |
|
amended to read as follows: |
|
(a) This section applies only to a municipality [with a
|
|
population of less than 250,000] that is authorized under this |
|
title to purchase real property or personal property that is not |
|
affixed to real property. |
|
SECTION 3. The changes in law made by this Act apply only to |
|
a contract for which the initial notice soliciting bids is given on |
|
or after the effective date of this Act. A contract for which the |
|
initial notice soliciting bids is given before that date is |
|
governed by the law in effect when the initial notice is given, and |
|
the former law is continued in effect for that purpose. |
|
SECTION 4. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2011. |
