BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subchapter H, Chapter 242, Health and Safety | ||
Code, is amended by adding Section 242.2015 to read as follows: | ||
Sec. 242.2015. TRAINING REQUIREMENT FOR FACILITY PERSONNEL | ||
PROVIDING ALZHEIMER'S CARE; PROHIBITED ADVERTISEMENT. A nursing | ||
facility may not advertise, market, or otherwise promote the | ||
facility's Alzheimer's care unit or memory care unit as providing | ||
services to residents with Alzheimer's disease and related | ||
disorders unless the facility provides the services through | ||
specially trained personnel who have successfully completed a | ||
minimum of four training hours in caring for those residents as | ||
prescribed by commission rule. | ||
SECTION 2. Subchapter B, Chapter 247, Health and Safety | ||
Code, is amended by adding Section 247.0297 to read as follows: | ||
Sec. 247.0297. TRAINING REQUIREMENT FOR FACILITY PERSONNEL | ||
PROVIDING ALZHEIMER'S CARE; PROHIBITED ADVERTISEMENT. An assisted | ||
living facility may not advertise, market, or otherwise promote the | ||
facility's Alzheimer's care unit or memory care unit as providing | ||
services to residents with Alzheimer's disease and related | ||
disorders unless the facility provides the services through | ||
specially trained personnel who have successfully completed a | ||
minimum of four training hours in caring for those residents as | ||
prescribed by commission rule. | ||
SECTION 3. Not later than December 1, 2023, the executive | ||
commissioner of the Health and Human Services Commission shall | ||
adopt the rules necessary to implement the changes in law made by | ||
this Act. | ||
SECTION 4. The changes in law made by this Act apply only to | ||
advertising, marketing, or promoting conducted on or after January | ||
1, 2024. | ||
SECTION 5. This Act takes effect September 1, 2023. |
