relating to reports by the Texas Commission on Environmental | ||
Quality about dams that have certain hazard classifications. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 12.052, Water Code, is amended by adding | ||
Subsection (e-3) to read as follows: | ||
(e-3) For purposes of this subsection, the emergency | ||
management director for a political subdivision is the person | ||
designated the subdivision's emergency management director by | ||
Section 418.1015, Government Code. The commission shall provide a | ||
report of a dam that has a hazard classification of high or | ||
significant to the emergency management director for the political | ||
subdivision in which the dam is located. The commission shall make a | ||
report to the emergency management director not later than: | ||
(1) the 48th hour after the time of the designation of | ||
a dam as a high hazard classification; or | ||
(2) the 30th day after the date of the designation of a | ||
dam as a significant hazard classification. | ||
SECTION 2. For each dam that, as of the effective date of | ||
this Act, the executive director of the Texas Commission on | ||
Environmental Quality maintains a classification of high or | ||
significant hazard, the commission shall provide a report regarding | ||
the hazard classification of the dam to the emergency management | ||
director for the political subdivision in which the dam is located | ||
as provided by Section 12.052(e-3), Water Code, as added by this | ||
Act. Each report must be provided as soon as practicable and not | ||
later than March 1, 2020. | ||
SECTION 3. This Act takes effect September 1, 2019. |
