relating to the use of a school as a polling place. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 43.031, Election Code, is amended by | ||
adding Subsection (f) to read as follows: | ||
(f) Notwithstanding Subsection (c), if the building | ||
selected for a polling place under this section is a school, the | ||
entity that owns or controls the building may deny the authority | ||
holding the election use of the building as a polling place if the | ||
entity that owns or controls the building can demonstrate that | ||
using the building as a polling place is reasonably likely to result | ||
in unsecured access to students on the building's campus. This | ||
subsection does not apply if classes are suspended during the time | ||
the building is in use as a polling place. The secretary of state | ||
shall adopt rules for the administration of this subsection. | ||
SECTION 2. This Act takes effect September 1, 2017. |
