AN ACT

Amending Title 75 (Vehicles) of the Pennsylvania Consolidated

2

Statutes, in registration of vehicles, further providing for

3

department vehicle registration records.

4

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

6

Section 1.  Section 1316 of Title 75 of the Pennsylvania

7

Consolidated Statutes is amended to read:

8

§ 1316.  Department records.

9

(a)  General rule.--The department shall maintain suitable

10

records in a manner permitting identification of vehicles and

11

owners, including:

12

(1)  All registrations and transfers of registrations

13

issued.

14

(2)  All registrations and transfers of registrations

15

denied and reasons for denial. Registrations and transfers

16

returned for correction of errors or omissions need not be

17

recorded.

(b)  Confidential registration.--

(1)  Subject to paragraph (3), a confidential

2

registration of a vehicle as to which the records of the

3

department are available only as prescribed by this section

4

may be issued to:

5

(i)  A governmental law enforcement agency for a

6

vehicle used to any extent for undercover or surveillance

7

purposes.

8

(ii)  Commonwealth departments and other agencies for

9

vehicles assigned to department secretaries and deputy

10

secretaries and heads of other agencies.

11

(iii)  A judge or magisterial district judge.

12

(iv)  A district attorney.

13

(2)  Application for a confidential registration shall be

14

made on a form furnished by the department.

15

(3)  Information concerning the identity of the

16

registrant of a confidential registration shall be provided

17

only upon written request of the registrant or a law

18

enforcement agency.

19

(4)  Upon receipt of a request for information concerning

20

a confidential registration from any person or entity other

21

than the registrant or a law enforcement agency, the

22

department shall inform the requester that the identity of

23

the registrant is confidential and shall notify the

24

registrant of the identity of the requester.

25

Section 2.  This act shall take effect in 180 days.
