AN ACT
Authorizing and directing the Department of Transportation, with
the approval of the Governor, to convey to Wilkes-Barre
Township a parcel of land situated in the Township of Wilkes-
Barre, Luzerne County, Pennsylvania.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. The Department of Transportation, with the
approval of the Governor, is hereby authorized and directed, on
behalf of the Commonwealth of Pennsylvania, to grant and convey
to Wilkes-Barre Township for 50% of the fair market value as
determined by an independent appraisal approved by the
Department of Transportation the following parcel of land
situated in the Township of Wilkes-Barre, Luzerne County,
Pennsylvania, bounded and described as follows:
All that certain lot, piece or parcel of land situate in the
Township of Wilkes-Barre, County of Luzerne and State of
Pennsylvania bounded and described as follows to wit:
Beginning at a point on the Easterly right of way line of State
Route 81 (Legislative Route 1005 Section 4-2) said point being
located 130.00 Feet right of Station 1423+00.00 (Northbound
baseline).
Thence North 29 degrees 23 minutes 20 seconds West 30.00 Feet to
a point;
Thence along a 7539.49 Feet radius curve to the Left (chord
bears South 58 degrees 44 minutes 10 seconds West-493.37) 493.46
Feet to a point;
Thence South 33 degrees 8 minutes 20 seconds East 50.00 Feet to
a point on the Easterly right of way line of State Route 81
(Legislative Route 1005 Section 4-2);
Thence continuing along said right of way line along a 7489.49
Feet radius curve to the Right (chord bears North 57 degrees 47
minutes 55 seconds East-245.08) 245.09 Feet to a point;
Thence continuing along said right of way line North 31 degrees
15 minutes 50 seconds West 20.00 Feet to a point;
Thence continuing along said right of way line along a 7509.49
Feet radius curve to the Right (chord bears North 59 degrees 40
minutes 25 seconds East-245.73) 245.75 Feet to the Point of
Beginning.
Containing an area of 19682.57 Square Feet or .45 Acres of land.
Section 2. The deed of conveyance shall contain a
reversionary clause by which any of the land conveyed shall
revert to the Commonwealth if it shall no longer be used for
public school purposes, shall be approved as provided by law and
shall be executed by the Secretary of Transportation in the name
of the Commonwealth of Pennsylvania.
Section 3. Costs and fees incidental to this conveyance
shall be borne by the grantee.
Section 4. Moneys received from the conveyance shall be
deposited in the Motor License Fund.
