AN ACT

  

1

Providing for an extension of approvals granted by a government

2

agency during the period beginning after December 31, 2008,

3

and ending before July 2, 2011.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

6

Section 1.  Short title.

7

This act shall be known and may be cited as the Building

8

Permit Extension Act.

9

Section 2.  Definitions.

10

The following words and phrases when used in this act shall

11

have the meanings given to then in this section unless the

12

context clearly indicates otherwise:

13

"Approval."  An authorization granted by a government agency

14

in the form of a permit, approval, license, certification,

15

permission, determination, exemption, variance, exception,

16

waiver, letter of interpretation or agreement that allows a

17

development or construction project to proceed.

"Development."  Any of the following:

(1)  The division of a parcel of land into two or more

2

parcels.

(2)  The construction, reconstruction, conversion,

4

structural alteration, relocation or enlargement of a

5

building or other structure or facility.

6

(3)  Grading, soil removal, relocation, excavation or

7

landfill.

8

(4)  A use or change in the use of a building or other

9

structure or change in land use.

10

"Extension period."  The period beginning after December 31,

11

2008, and ending before July 2, 2011.

"Government agency."  An agency, department, commission or

13

board of the Commonwealth or of a political subdivision of the

14

Commonwealth. The term includes regional commissions, boards or

15

other instrumentalities.

Section 3.  Existing approval.

17

(a)  Automatic suspension.--The expiration date of an

18

approval by a government agency relating to development that is

19

granted for or in effect during the extension period shall be

20

automatically suspended during the extension period. The

21

automatic suspension of the expiration of an approval under this

22

section shall not extend the approval for more than six months

23

beyond the conclusion of the extension period.

24

(b)  Duration.--Nothing in this section shall shorten the

25

duration an approval relating to development would have had in

26

the absence of the enactment of this section. Nothing in this

27

section shall prohibit the granting of additional extensions as

28

provided by law.

Section 4.  Applicability.

This act shall not apply to any of the following:

(1)  An approval issued by an agency of the United States

2

or an approval issued the duration of which is specified or

3

determined by Federal law or regulation.

4

(2)  An approval issued by the Department of

5

Transportation.

6

(3)  An administrative consent order or other enforcement

7

action by the Department of Environmental Protection.

8

Section 20.  Effective date.

9

This act shall take effect in 60 days.
