| AN ACT |
| |
1 | Amending Title 75 (Vehicles) of the Pennsylvania Consolidated |
2 | Statutes, further providing for disqualification for |
3 | commercial driver's license. |
4 | The General Assembly of the Commonwealth of Pennsylvania |
5 | hereby enacts as follows: |
6 | Section 1. Section 1611(a)(5) of Title 75 of the |
7 | Pennsylvania Consolidated Statutes is amended to read: |
8 | § 1611. Disqualification. |
9 | (a) First violation of certain offenses.--Upon receipt of a |
10 | report of conviction, the department shall, in addition to any |
11 | other penalties imposed under this title, disqualify any person |
12 | from driving a commercial motor vehicle or school vehicle for a |
13 | period of one year for the first violation of: |

15 | (5) any felony or any misdemeanor under 18 Pa.C.S. Ch. |
16 | 39 (relating to theft and related offenses) in the commission |
17 | of which a court determines a motor vehicle was essentially |
18 | involved and where the person was a commercial driver at the |

2 | subsection (e); |
