AN ACT

Amending Titles 24 (Education) and 71 (State Government) of the

2

Pennsylvania Consolidated Statutes, providing for retirement

3

eligibility.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

6

Section 1.  Title 24 of the Pennsylvania Consolidated

7

Statutes is amended by adding a section to read:

8

§ 8314.  Eligibility for retirement.

9

(a)  General rule.--A member shall be entitled to receive a

10

maximum single life annuity calculated pursuant to section 8342

11

(relating to maximum single life annuity) without any reduction

12

by virtue of an effective date of retirement which is under the

13

superannuation age, if the member meets the requirements set

14

forth in subsection (b).

(b)  Requirements.--The entitlement provided under subsection

16

(a) shall be applicable to any eligible member who, on or after

17

the effective date of this section:

18

(1)  has credit for at least 30 eligibility points;

(2)  terminates school service; and

2

(3)  files an application for an annuity with an

3

effective date of retirement after the completion of the

4

school term but in no case earlier than May 15 nor later than

5

the ensuing July 15.

(c)  Definitions.--As used in this section, "school term"

7

either shall have the meaning assigned to it in section 102 of

8

the act of March 10, 1949 (P.L.30, No.14), known as the Public

9

School Code of 1949, as it relates to school entities, or shall

10

mean the calendar of academic terms or semesters published in

11

the catalog of an institution of higher education any of whose

12

employees is subject to membership in the retirement system.

Section 2.  Title 71 is amended by adding a section to read:

14

§ 5308.3.  Eligibility for retirement.

15

(a)  General rule.--A member shall be entitled to receive a

16

maximum single life annuity calculated pursuant to section 5702

17

(relating to maximum single life annuity) without any reduction

18

by virtue of an effective date of retirement which is under the

19

superannuation age, if the member meets the requirements set

20

forth in subsection (b).

21

(b)  Requirements.--The entitlement provided under subsection

22

(a) shall be applicable to any eligible member who, on or after

23

the effective date of this section:

24

(1)  has credit for at least 30 eligibility points;

25

(2)  terminates State service; and

26

(3)  files an application for an annuity.

27

Section 3.  This act shall take effect immediately.
