| AN ACT |
| |
1 | Amending Title 34 (Game) of the Pennsylvania Consolidated |
2 | Statutes, in hunting and furtaking, further providing for |
3 | unlawful acts concerning licenses; and, in special licenses | <-- |
4 | and permits, further providing for authority to issue |
5 | permits, for permit fees and for falconry permits. |
6 | The General Assembly of the Commonwealth of Pennsylvania |
7 | hereby enacts as follows: |
8 | Section 1. Section 2711 of Title 34 of the Pennsylvania |
9 | Consolidated Statutes is amended by adding a subsection to read: |
10 | § 2711. Unlawful acts concerning licenses. |

12 | (a.1) Exemption.--For the sole purpose of implementing and |
13 | enhancing a mentored youth hunting program within this |
14 | Commonwealth, the commission may establish regulations exempting |
15 | certain limited youth hunting activities from the prohibitions |
16 | specified in subsection (a)(1), (3), (5) and (8). Such exemption |
17 | shall include a provision limiting a mentored youth |
18 | participating in a mentored youth hunting program to the receipt |

1 | of no more than one antlerless deer license in each license |
2 | year. |

4 | Section 2. Sections 2901(e), 2904(a)(7) and 2925(a) and (b) | <-- |
5 | of Title 34 are amended to read: |
6 | § 2901. Authority to issue permits. |

8 | (e) Falconry permits.--Notwithstanding the provisions of |
9 | subsection (a), falconry permits may be issued only to persons |
10 | who are residents of this Commonwealth and [16] 12 years of age |
11 | or older. |
12 | § 2904. Permit fees. |
13 | (a) Annual fees.--The annual fee for permits provided for in |
14 | this chapter shall be as follows: |

16 | (7) Falconry - [$25 for each raptor held] $50. |

18 | § 2925. Falconry permits. |
19 | (a) Powers of commission.--The commission may adopt |
20 | regulations [consistent with Federal fish and wildlife laws and |
21 | regulations concerning the sport of falconry] to define, |
22 | implement and provide for the issuance of falconry permits to |
23 | eligible persons within this Commonwealth. |
24 | (b) Unlawful acts.--It is unlawful [to practice any of the |
25 | actions defined as falconry under this section without a |
26 | falconry permit or to violate any regulation of the commission |
27 | or the United States Fish and Wildlife Service, whose |
28 | regulations pertaining to falconry are hereby made a part of |
29 | this title] for any person to engage in any falconry activities |
30 | without a valid falconry permit or to violate any regulation of |
