AN ACT

Amending Title 42 (Judiciary and Judicial Procedure) of the

2

Pennsylvania Consolidated Statutes, providing for sentencing

3

for offenses committed in association with a criminal street

4

gang.

5

The General Assembly of the Commonwealth of Pennsylvania

6

hereby enacts as follows:

7

Section 1.  Title 42 of the Pennsylvania Consolidated

8

Statutes is amended by adding a section to read:

9

§ 9720.3.  Sentencing for offenses committed in association with

10

a criminal street gang.

11

(a)  Sentencing enhancement.--The Pennsylvania Commission on

Sentencing shall provide for a sentence enhancement for the

13

following:

14

(1)  Where a person commits a crime of violence or a

15

violation of section 13(a)(30) of the act of April 14, 1972

16

(P.L.233, No.64), known as The Controlled Substance, Drug,

Device and Cosmetic Act, if the offense was knowingly

2

committed at the direction of or for the purpose of

3

benefiting, promoting or furthering the interests of a

4

criminal street gang.

5

(2)  Where a person causes, encourages, recruits,

6

solicits or coerces another to join, participate in or assist

7

a criminal street gang in committing any criminal offense

8

that is defined as a crime of violence or a violation of

9

section 13(a)(30) of The Controlled Substance, Drug, Device

10

and Cosmetic Act.

11

(3)  Where a person communicates, directly or indirectly,

12

to another person a threat of injury or damage to the person

13

or property of that person or to an associate or relative of

14

that person with the intent to do either of the following:

15

(i)  Deter the other person from assisting a gang

16

member or associate of a gang to withdraw from the gang.

17

(ii)  Punish or retaliate against the other person

18

for having withdrawn from a gang.

19

(b)  Proof at sentencing.--The provisions of this section

20

shall not be an element of the crime and notice of the

21

provisions of this section to the defendant shall not be

22

required prior to conviction, but reasonable notice of the

23

Commonwealth's intention to proceed under this section shall be

24

provided after conviction and before sentencing.

25

(c)  Applicability.--The applicability of this section shall

26

be determined at sentencing. The court shall consider any

27

evidence presented at trial and shall afford the Commonwealth

28

and the defendant an opportunity to present any necessary

29

additional evidence and shall determine, by a preponderance of

30

the evidence, if this section is applicable.

(d)  Definitions.--As used in this section, the following

2

words and phrases shall have the meanings given to them in this

3

subsection unless the context clearly indicates otherwise:

4

"Crime of violence."  An offense under any of the following:

5

(1)  18 Pa.C.S. Ch. 25 (relating to criminal homicide).

6

(2)  18 Pa.C.S. Ch. 26 (relating to crimes against unborn

7

child).

8

(3)  18 Pa.C.S. Ch. 27 (relating to assault).

9

(4)  18 Pa.C.S. § 2901 (relating to kidnapping).

10

(5)  18 Pa.C.S. Ch. 31 (relating to sexual offenses).

11

(6)  18 Pa.C.S. § 3125 (relating to aggravated indecent

12

assault).

13

(7)  18 Pa.C.S. § 3301(a) (relating to arson and related

14

offenses).

15

(8)  18 Pa.C.S. § 3502 (relating to burglary), if at the

16

time of the offense the structure entered was adapted for

17

overnight accommodation.

18

(9)  18 Pa.C.S. § 3701 (relating to robbery).

19

(10)  18 Pa.C.S. § 3702 (relating to robbery of motor

20

vehicle).

21

(11)  An offense under 18 Pa.C.S. Ch. 49, Subch. B

22

(relating to victim and witness intimidation), involving a

23

witness to or a victim of a violation of any offense

24

enumerated under this definition.

25

(12)  A crime equivalent to one listed under this

26

subsection under the laws of this Commonwealth in effect at

27

the time of the commission of the offense.

28

(13)  A crime equivalent to one listed under this

29

subsection under Federal law or in a jurisdiction outside

30

this Commonwealth.

(14)  A criminal attempt, conspiracy or solicitation to

2

commit an offense enumerated under this subsection.

(a)  Sentencing enhancement.--The Pennsylvania Commission on

Sentencing, in accordance with 42 Pa.C.S. § 2154 (relating to

5

adoption of guidelines for sentencing), shall provide for a

6

sentence enhancement for gang-related crimes, if any one of the

7

following applies:

8

(1)  A gang-related crime was knowingly committed at the

9

direction of or for the purpose of benefiting, promoting or

10

furthering the interests of a criminal street gang.

11

(2)  The person causes, encourages, recruits, solicits or

12

coerces another to assist a criminal street gang in the

13

commission of a gang-related crime or to participate in the

14

commission of a gang-related crime with a criminal street

15

gang.

16

(3)  The person communicates, directly or indirectly, a

17

threat of the commission of a gang-related crime and the

18

intent of the threat is to:

19

(i)  deter another person or a relative or associate

20

of another person from helping a member or associate of a

21

criminal street gang to withdraw from a gang; or

22

(ii)  punish another person or deter another person

23

or a relative or associate of another person from

24

withdrawing from a criminal street gang.

25

(b)  Definitions.--As used in this section, the following

26

words and phrases shall have the meanings given to them in this

27

subsection unless the context clearly indicates otherwise:

28

"Criminal street gang."  A formal or informal confederation,

29

alliance, network, conspiracy, understanding or similar

30

conjoining of persons who operate individually or collectively

as a group or subgroup, with or without an established

2

hierarchy, that, through its membership obtained by pledge,

3

oath, swearing, ritual, distinct membership markings, symbolism,

4

common identifiers or other criteria that law enforcement

5

personnel use to identify the groups or subgroups, engages in

6

criminal activity.

7

"Gang-related crime."  Any of the following:

(1)  Section 13(a)(30) of the act of April 14, 1972 (P.L.

9

233, No.64), known as The Controlled Substance, Drug, Device

10

and Cosmetic Act.

11

(2)  Any of the following provisions under 18 Pa.C.S.

12

(relating to crimes and offenses):

13

(i)  Section 2502 (relating to murder).

14

(ii)  Section 2503 (relating to voluntary

15

manslaughter).

16

(iii)  Section 2506 (relating to drug delivery

17

resulting in death).

18

(iv)  Section 2507(a) or (b) (relating to criminal

19

homicide of law enforcement officer).

20

(v)  Section 2701(a)(3) (relating to simple assault).

21

(vi)  Section 2702 (relating to aggravated assault).

22

(vii)  Section 2702.1 (relating to assault of law

23

enforcement officer).

24

(viii)  Section 2901 (relating to kidnapping).

25

(ix)  Section 3121 (relating to rape).

26

(x)  Section 3123 (relating to involuntary deviate

27

sexual intercourse).

28

(xi)  Section 3124.1 (relating to sexual assault).

(xii) Section 3125 (relating to aggravated indecent

30

assault).

(xiii)  Section 3301(a) (relating to arson and

2

related offenses).

(xiv)  Section 3502(a)(1) or (2) (relating to

4

burglary).

5

(xv)  Section 3701 (relating to robbery).

6

(xiv)  Section 3702 (relating to robbery of a motor

7

vehicle).

8

(xv)  Section 4952 (relating to intimidation of

9

witnesses or victims), if the offense involved a victim

10

or witness to a gang-related crime.

11

(xvi)  Section 4953 (relating to retaliation against

12

witness, victim or party), if the offense involved a

13

witness, victim or party of a gang-related crime.

14

(3)  A criminal attempt, solicitation or conspiracy to

15

commit an offense set forth in paragraph (1) or (2).

16

(4)  A crime equivalent to an offense set forth in

17

paragraph (1), (2) or (3) under the laws of this Commonwealth

18

in effect at the time of the commission of the offense.

19

(5)  A crime equivalent to an offense set forth in

20

paragraph (1), (2) or (3) under Federal law or a jurisdiction

21

outside this Commonwealth.

22

Section 2.  This act shall take effect in 60 days.
