AN ACT

Amending the act of June 3, 1937 (P.L.1333, No.320), entitled

"An act concerning elections, including general, municipal,

3

special and primary elections, the nomination of candidates,

4

primary and election expenses and election contests; creating

5

and defining membership of county boards of elections;

6

imposing duties upon the Secretary of the Commonwealth,

7

courts, county boards of elections, county commissioners;

8

imposing penalties for violation of the act, and codifying,

9

revising and consolidating the laws relating thereto; and

10

repealing certain acts and parts of acts relating to

11

elections," Title 65 (Public Officers) of the Pennsylvania

Consolidated Statutes, providing for mailings by members of

13

General Assembly.

The General Assembly of the Commonwealth of Pennsylvania

15

hereby enacts as follows:

16

Section 1.  The act of June 3, 1937 (P.L.1333, No.320), known

as the Pennsylvania Election Code, is amended by adding a

18

section to read:

19

Section 1634.2.  Mailings by Members of the

20

Section 1.  Section 1103 of Title 65 of the Pennsylvania

Consolidated Statutes is amended by adding a subsection to read:

§ 1103.  Restricted activities.

(k)  Mailings by members of General Assembly.--No 

3

reimbursement or expenditure may be made out of any

4

appropriation account for a mass mailing, including a bulk rate

5

mailing, made at the direction or on behalf of a member of the

6

General Assembly that is mailed or delivered to a postal

7

facility within sixty (60) 60 days immediately preceding any

primary or general election at which the member is a candidate

9

for public office.

Section 2.  Section 1109(b) of Title 65 is amended to read:

§ 1109.  Penalties.

12

(b)  Financial interests statement violation.--Any person who

14

violates the provisions of section 1103(d) through [(j)] (k),

15

1104 (relating to statement of financial interests required to

16

be filed) or 1105(a) (relating to statement of financial

17

interests) commits a misdemeanor and shall, upon conviction, be

18

sentenced to pay a fine of not more than $1,000 or to

19

imprisonment for not more than one year, or both.

Section 2 3.  This act shall take effect in 60 days.
