AN ACT

Amending Title 65 (Public Officers) of the Pennsylvania

Consolidated Statutes, providing for mailings by members of

General Assembly certain public officials.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

6

Section 1.  Section 1103 of Title 65 of the Pennsylvania

7

Consolidated Statutes is amended by adding a subsection to read:

8

§ 1103.  Restricted activities.

(k)  Mailings by members of General Assembly certain public

officials.--No reimbursement or expenditure may be made out of

12

any appropriation account for a mass mailing, including a bulk

13

rate mailing, made at the direction or on behalf of a member of

14

the General Assembly, the Governor, Lieutenant Governor,

15

Attorney General, Auditor General or State Treasurer that is

16

mailed or delivered to a postal facility within 60 days

17

immediately preceding any primary or general election at which

the member such person is a candidate for public office.

Section 2.  Section 1109(b) of Title 65 is amended to read:

§ 1109.  Penalties.

4

(b)  Financial interests statement violation.--Any person who

6

violates the provisions of section 1103(d) through [(j)] (k),

7

1104 (relating to statement of financial interests required to

8

be filed) or 1105(a) (relating to statement of financial

9

interests) commits a misdemeanor and shall, upon conviction, be

10

sentenced to pay a fine of not more than $1,000 or to

11

imprisonment for not more than one year, or both.

Section 3.  This act shall take effect in 60 days.
