AN ACT
Providing for the highway capital budget project itemization for
flood-damaged highways to be financed from revenue from the
Motor License Fund.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Short title.
This act shall be known and may be cited as the Capital
Budget Act of 2011 for Highways Damaged by Hurricane Irene and
Tropical Storm Lee.
Section 2. Authorization.
The total authorization for the capital projects in the
category of highway projects itemized in sections 4 through 70
and to be constructed by the Department of Transportation, its
successors or assigns, and to be financed from current revenue
of the Motor License Fund shall be $66,783,000.
Section 3. Itemization of highway projects.
Additional capital projects in the category of public highway
projects to be constructed by the Department of Transportation,
its successors or assigns, and to be financed from current
revenue of the Motor License Fund are hereby itemized, together
with their respective estimated financial costs, in the
following sections.

Section 71. Estimated useful life of projects.
The General Assembly states the estimated useful life of the
projects itemized is 30 years.
Section 72. Federal funds.
All moneys received from the Federal Government for the

construction of the public highway projects specifically
itemized herein are also hereby appropriated for those projects.
Section 73. Construction.
Amounts contained in this act for any project shall not
supplant or replace any Federal funds authorized by any Federal
law or regulation. Funding from this act for any project is
available only to the extent that Federal funds are not
available for such project.
Section 74. Allocation of funds.
Whenever as determined by the Department of Transportation
that the full estimated financial costs of the projects itemized
in sections 4 through 70 are not necessary for the proper
design, acquisition or construction of such projects, the excess
funds no longer required may be allocated by the Department of
Transportation to increase the estimated costs of any one or
more of the projects specifically itemized in a capital budget.
Section 75. Effective date.
This act shall take effect immediately.
