AN ACT

Amending Title 53 (Municipalities Generally) of the Pennsylvania

2

Consolidated Statutes, in municipal authorities, further

3

providing for governing body.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

6

Section 1.  Section 5610(d) and (e) of Title 53 of the

7

Pennsylvania Consolidated Statutes are amended to read:

8

§ 5610.  Governing body.

(d)  Successor.--Members shall hold office until their

11

successors have been appointed and may succeed themselves and,

12

except members of the boards of authorities organized or created

13

by a school district, shall receive such [salaries] monthly

14

stipends and reimbursement for reasonable travel expenses

15

incurred in the performance of their official duties as may be

16

determined by the governing body of the municipality, but no

17

[salaries] stipend shall be increased or diminished by a

18

governing body during the term for which the member shall have

been appointed. Members of the board of any authority organized

2

or created by a school district shall receive no compensation

3

for their services. A member may be removed for cause by the

4

court of common pleas of the county in which the authority is

5

located after having been provided with a copy of the charges

6

against him for at least ten days and after having been provided

7

a full hearing by the court. If a vacancy shall occur by reason

8

of the death, disqualification, resignation or removal of a

9

member, the municipal authorities shall appoint a successor to

10

fill his unexpired term. In joint authorities such vacancies

11

shall be filled by the municipal authorities of the municipality

12

in the representation of which the vacancy occurs. If any

13

municipality withdraws from a joint authority, the term of any

14

member appointed from the municipality shall immediately

15

terminate.

(e)  Quorum.--A majority of the members shall constitute a

17

quorum of the board for the purpose of organizing and conducting

18

the business of the authority and for all other purposes, and

19

all action may be taken by vote of a majority of the members

20

present unless the bylaws shall require a larger number. The

21

board shall have full authority to manage the properties and

22

business of the authority and to prescribe, amend and repeal

23

bylaws, rules and regulations governing the manner in which the

24

business of the authority may be conducted and the powers

25

granted to it may be exercised and embodied. The board shall fix

26

and determine the number of officers, agents and employees of

27

the authority and their respective powers, duties and

28

compensation and may appoint to such office or offices any

29

member of the board with such powers, duties and compensation as

30

the board may deem proper. No member of the board who is

appointed by the board to any office shall be entitled to

2

receive any compensation or other remuneration for the

3

performance of the duties of that office, except for the stipend

4

and reimbursement of reasonable travel expenses authorized under

5

subsection (d). The treasurer of the board of any authority

6

organized or created by a school district shall give bond in

7

such sums as may be fixed by the bylaws, which bond shall be

8

subject to the approval of the board and the premiums for which

9

shall be paid by the authority.
