AN ACT

Providing for the Cell Tower and Antenna Siting on Commonwealth

2

Property Act; and imposing duties on the Office of

3

Administration.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

6

Section 1.  Short title.

7

This act shall be known and may be cited as the Cell Tower

8

and Antenna Siting on Commonwealth Property Act.

9

Section 2.  Single point of contact.

10

The Office of Administration is designated as the single

11

point of contact for Commonwealth agencies for siting cell

12

towers and antennas on Commonwealth property.

13

Section 3.  Process.

14

The Office of Administration shall develop a process to

15

manage siting cell phone towers and antennas on Commonwealth

16

property that shall include the following:

(1)  Establishing the Office of Public Safety Radio

18

Systems or another office as a managing entity.

(2)  Establishing a process to develop market-based costs

2

for use of the cell tower.

3

(3)  Establishing insurance and bond requirements.

4

(4)  Being the liaison agency to work with the agency

5

owning the Commonwealth property. This shall include

6

reviewing requests for conformance with property owning

7

agency's goals such as the maintenance of park vistas.

8

(5)  Encouraging the collocation of facilities on

9

existing towers to restrict unnecessary proliferation of

10

towers.

11

(6)  Requiring new towers to have the capacity for future

12

collocation of facilities, if possible.

Section 4.  Inventory.

The Office of Administration, with the assistance of relevant

15

Commonwealth agencies, shall undertake a complete inventory of

16

cell phone towers located on Commonwealth property.

17

Section 5.  Review.

18

The Office of Administration shall review the leases,

19

licenses and contracts in place with cell phone companies to

20

ensure that lease rates are commensurate with the locations of

21

towers and their accompanying equipment.

22

Section 20.  Effective date.

23

This act shall take effect in 90 days.
