AN ACT

Amending the act of June 13, 1967 (P.L.31, No.21), entitled "An

2

act to consolidate, editorially revise, and codify the public

3

welfare laws of the Commonwealth," providing for electronic

4

prior approval for Medicaid.

The General Assembly of the Commonwealth of Pennsylvania

6

hereby enacts as follows:

7

Section 1.  The act of June 13, 1967 (P.L.31, No.21), known

8

as the Public Welfare Code, is amended by adding a section to

9

read:

10

Section 450.  Electronic Prior Approval Process.--The

11

Medicaid program Medical Assistance Fee for Service Program

shall have an electronic prior approval process in place by

January 1, 2010, 60 days after the effective date of this

section for use by physicians to secure approval of all

preferred and nonpreferred drugs. Nonpreferred drugs prescribed

2

by Pennsylvania licensed physicians specializing in the field of

3

psychiatry shall be exempt from prior authorization

4

requirements. The department shall draft guidelines to update

5

lists and processes on a regular basis in order to best meet the

6

needs of the citizens of this Commonwealth.

Section 2.  This act shall take effect in 60 180 days.
