AN ACT

Providing for small disaster assistance, for low-interest loans

2

to individual disaster victims and businesses and for

3

municipal grants; establishing a fund; and conferring powers

4

and duties on various Commonwealth agencies.

5

The General Assembly of the Commonwealth of Pennsylvania

6

hereby enacts as follows:

7

Section 1.  Short title.

8

This act shall be known and may be cited as the Small

9

Disaster Assistance Act.

10

Section 2.  Declaration of policy.

11

The General Assembly finds and declares as follows:

12

(1)  Many communities in this Commonwealth frequently are

13

subject to natural and manmade disasters which cause

14

significant damage and disruption in the life of the

15

community but which are not of sufficient magnitude to

16

qualify for Federal disaster assistance programs.

17

(2)  Nevertheless, losses under paragraph (1) are of

considerable importance to those directly affected and their

2

communities and to the health and welfare of the citizens of

3

this Commonwealth.

Section 2.  Definitions.

5

The following words and phrases when used in this act shall

6

have the meanings given to them in this section unless the

7

context clearly indicates otherwise:

8

"Agency."  The Pennsylvania Emergency Management Agency.

9

"Assistance."  Any of the following:

10

(1)  A loan under:

11

(i)  section 6; or

12

(ii)  section 7.

13

(2)  A grant under section 8.

14

"Business."  The term includes nonprofit organizations and

15

the nonsectarian portion of religious facilities.

16

"Cost-of-living increase."  The amount of increase equal to

17

the percentage change in the Consumers Price Index for All Urban

18

Consumers (CPI-U) for the Pennsylvania, New Jersey, Delaware and

19

Maryland area for the most recent 12-month period for which

20

figures have been officially reported by the Bureau of Labor

21

Statistics immediately prior to the date the adjustment is to

22

take effect.

23

"Department."  The Department of Community and Economic

24

Development of the Commonwealth.

25

"Fund."  The Small Disaster Assistance Fund established in

26

section 4.

27

"Small disaster."  An event which meets all of the following

28

paragraphs:

29

(1)  Occurs after June 30, 2011.

30

(2)  Results in total uninsured losses for all affected

individuals and businesses of not more than $2,000,000.

2

(3)  Falls below the current Federal guidelines for

3

Federal disaster assistance.

4

(4)  Involves:

5

(i)  damage exceeding 40% of the total value of a

6

structure and contents of each of at least five homes or

7

two businesses;

8

(ii)  loss of life; or

9

(iii)  total estimated damages of at least $250,000

10

to public facilities.

11

Section 3.  Agency.

12

The agency has the following powers and duties:

13

(1)  Administer the fund. This includes seeking:

14

(i)  appropriations under section 4(c)(1); and

15

(ii)  Federal money under section 4(c)(2).

16

(2)  Coordinate assistance among administering agencies

17

under section 5(c).

18

(3)  Make an annual report to the Secretary of the Senate

19

and the Chief Clerk of the House of Representative on the

20

implementation of this act.

21

Section 4.  Fund.

22

(a)  Establishment.--There is established in the State

23

Treasury the Small Disaster Assistance Fund.

24

(b)  Purpose.--The purpose of the fund is to assist the

25

victims of small disasters with low-interest loans and grants.

26

(c)  Sources.--The following are the sources of the fund:

27

(1)  Appropriations.

28

(2)  Federal money available for small disaster

29

assistance.

30

(3)  Repayment of loans under this act.

(4)  Return on money in the fund.

(d)  Administration.--The agency shall administer the fund.

3

(e)  Nonlapse.--The money in the fund is continuously

4

appropriated into the fund. This appropriation shall not lapse

5

at the end of a fiscal year.

6

Section 5.  Program.

7

(a)  Small disaster declarations.--

8

(1)  A county emergency management director may petition

9

the agency for a declaration of a small disaster.

10

(2)  The agency shall determine whether to make the

11

declaration. A determination under this paragraph shall be

12

deemed a final order, subject to review under 2 Pa.C.S. Ch. 7

13

Subch. A (relating to judicial review of Commonwealth agency

14

action).

15

(b)  Effect.--

16

(1)  Except as set forth in paragraph (2), upon a

17

declaration under subsection (a), assistance shall be

18

available to individuals, businesses and municipalities,

19

within a county that suffered a level of physical damage from

20

the small disaster.

21

(2)  Assistance shall not be available to a person that:

22

(i)  owns property within a 100-year flood plain; and

23

(ii)  does not have flood insurance.

24

(c)  Administering agencies.--The agency shall coordinate

25

assistance with the following:

26

(1)  For residential housing and contents, the

27

Pennsylvania Housing Finance Agency.

28

(2)  For business and municipal programs, the department.

29

Section 6.  Individual loans.

(a)  Eligibility.--

(1)  An individual is eligible for a loan if, as a result

2

of a small disaster, the individual has suffered damage to:

3

(i)  the real property of the individual's primary

4

residence; or

5

(ii)  personal property in the individual's primary

6

residence.

7

(2)  Subject to subsection (c), the loan may be for any

8

of the following:

9

(i)  To investigate flood damage.

10

(ii)  To repair or replace property under paragraph

11

(1). This subparagraph includes removal of debris.

12

(iii)  Elevation of primary residence.

13

(iv)  A flood mitigation project.

14

(3)  The amount of the loan shall not exceed the

15

following:

16

(i)  In a household comprised of more than one

17

individual, the lesser of:

18

(A)  $7,500 per individual; or

19

(B)  $30,000 per household.

20

(ii)  In a household comprised of one individual,

21

$15,000.

22

(b)  Interest.--A loan shall bear interest for the entire

23

term at a rate no greater than the annual cost-of-living

24

increase in the year in which the loan is granted.

25

(c)  Coverage.--A loan shall cover only that portion of loss

26

not covered by insurance.

27

Section 7.  Business loans.

28

(a)  Eligibility.--A business is eligible for a loan if, as a

29

result of a small disaster, any of the following are lost or

30

seriously damaged:

(1)  Real property. This paragraph includes a leasehold

2

improvement.

3

(2)  Fixed equipment.

4

(3)  Major movable equipment.

5

(4)  Furnishings.

6

(5)  Inventory, if it can be shown that an insurance

7

policy at a reasonable premium in relation to value was not

8

available to replace the inventory.

9

(b)  Purpose.--A loan may be for any of the following:

10

(1)  To investigate flood damage.

11

(2)  To repair or replace property under subsection (a).

12

This paragraph includes removal of debris.

13

(3)  Elevation of a structure.

14

(4)  A flood mitigation project.

15

(c)  Security.--A loan must be secured by one of the

16

following:

17

(1)  A mortgage on the real property of the business.

18

(2)  Collateral acceptable to the department.

19

(d)  Amount.--

20

(1)  Subject to paragraph (2), the department may lend an

21

amount of up to 150% of eligible repair or replacement costs

22

to assist in business retention and recovery.

23

(2)  The sum of all business loans in a fiscal year may

24

not be more than one-half of the money available for

25

expenditure in the fund in that fiscal year.

26

(e)  Interest.--A loan shall bear interest for the entire

27

term at a rate no greater than the annual cost-of-living

28

increase in the year in which the loan is granted.

29

(f)  Term.--

30

(1)  Except as set forth in paragraph (2), the maximum

term of a loan shall be 15 years.

(2)  The department may extend the term under paragraph

3

(1) if it determines a hardship.

4

Section 8.  Municipal grants.

5

(a)  Eligibility.--A municipality affected by a small

6

disaster may apply to the department for a grant to rectify

7

conditions or inadequate public facilities which:

8

(1)  led directly to the small disaster; or

9

(2)  contributed substantially to:

10

(i)  the occurrence of the small disaster; or

11

(ii)  the inability of local officials to bring the

12

damage under control.

13

(b)  Determination.--The department shall make a

14

determination on a grant based on all of the following:

15

(1)  Eligibility under subsection (a).

16

(2)  Available money in the fund.

17

(c)  Use.--A grant may be used for repairing or replacing all

18

of the following when lost or seriously damaged due to a small

19

disaster:

20

(1)  Municipal-owned buildings.

21

(2)  Municipal-owned major equipment other than vehicles,

22

plows, backhoes and similar gasoline-powered or diesel-

23

powered mobile machinery.

24

(3)  Municipal-owned office machines.

25

(4)  Municipal-maintained streets.

26

(5)  Municipal water and sewer lines and other public

27

utilities.

28

(6)  Municipal recreational facilities.

29

Section 20.  Effective date.

30

This act shall take effect in 60 days.
