AN ACT

Amending Title 74 (Transportation) of the Pennsylvania

2

Consolidated Statutes, in sustainable mobility options,

3

further providing for operating program and for asset

4

improvement program.

5

The General Assembly of the Commonwealth of Pennsylvania

6

hereby enacts as follows:

7

Section 1.  Sections 1513(d)(1) and (2) and 1514(c) of Title

8

74 of the Pennsylvania Consolidated Statutes are amended to

9

read:

10

§ 1513.  Operating program.

11

(d)  Local match requirements.--

13

(1)  For fiscal year 2007-2008 and each fiscal year

14

thereafter, except as provided under paragraph (2), financial

15

assistance provided under this section shall be matched by

16

local or private cash funding in an amount not less than the

17

greater of:

18

(i)  [15%] 25% of the amount of the financial

assistance being provided; or

2

(ii)  the amount required under former section

3

1311(d) (relating to use of funds distributed) for fiscal

4

year 2006-2007.

5

(2)  Beginning in fiscal year 2007-2008 and each fiscal

6

year thereafter, if the local matching funds provided are

7

less than [15%] 25% of the amount of financial assistance

8

received, the local transportation organization's required

9

local matching funds shall increase annually in order to meet

10

the 15% requirement set forth under paragraph (1)(i). The

11

local matching funds shall be increased annually by a minimum

12

of [5%] 10% above the amount of local matching funds provided

13

in the previous fiscal year unless a lesser amount is

14

necessary to meet the [15%] 25% requirement set forth under

15

paragraph (1)(i).

§ 1514.  Asset improvement program.

(c)  Local match requirements.--Financial assistance under

20

this section shall be matched by local or private cash funding

21

in an amount not less than [3.33%] 10% of the amount of the

22

financial assistance being provided. The source of funds for the

23

local match shall be subject to the requirements of section

24

1513(d)(3) (relating to operating program).

Section 2.  This act shall take effect in 60 days.
