| AN ACT |
| |
1 | Amending Title 71 (State Government) of the Pennsylvania |
2 | Consolidated Statutes, further providing for mandatory and |
3 | optional membership; and further regulating termination of |
4 | annuities. |
5 | The General Assembly of the Commonwealth of Pennsylvania |
6 | hereby enacts as follows: |
7 | Section 1. Section 5301(d) of Title 71 of the Pennsylvania |
8 | Consolidated Statutes is amended to read: |
9 | § 5301. Mandatory and optional membership. |

11 | (d) Return to service.--An annuitant who returns to service |
12 | as a State employee shall resume active membership in the system |
13 | as of the effective date of employment, except as otherwise |
14 | provided in section [5706(a)] 5706(a) and (d) (relating to |
15 | termination of annuities), regardless of the optional membership |
16 | category of the position. |

1 | Section 2. Section 5706 of Title 71 is amended by adding a |
2 | subsection to read: |
3 | § 5706. Termination of annuities. |

5 | (d) Exception.--An annuitant may return to State service as |
6 | a certified instructor in the municipal police officers' |
7 | education and training program, as provided in 53 Pa.C.S. § 2161 |
8 | (relating to establishment of program and scope of subchapter), |
9 | without being subject to the cessation of annuity provisions in |
10 | subsection (a), provided that the annuitant shall not receive |
11 | credit for such service and further provided that no member |
12 | contributions nor employer contributions shall be credited to |
13 | the annuitant's savings account for service authorized under |
14 | this subsection. |
15 | Section 3. This act shall take effect in 60 days. |
