AN ACT

  

1

Imposing a moratorium on the closure of the Scranton State

2

School for the Deaf; and requiring the Legislative Budget and

3

Finance Committee to study the operations and cost of the

4

Scranton State School for the Deaf and to report the findings

5

to the General Assembly.

The General Assembly of the Commonwealth of Pennsylvania

7

hereby enacts as follows:

8

Section 1.  Short title. 

9

This act shall be known and may be cited as the Scranton

10

State School for the Deaf Closure Moratorium Act.

11

Section 2.  Definitions.

12

The following words and phrases when used in this act shall

13

have the meanings given to them in this section unless the

context clearly indicates otherwise:

2

"Closure."  The closing, selling, leasing, transfer of

3

ownership or operational control of the Scranton State School

4

for the Deaf or a drastic reduction in educational services or

5

staff or any other act or omission that renders the school

6

inoperable.

7

"Committee."  The Legislative Budget and Finance Committee.

8

"Department."  The Department of Education of the

9

Commonwealth.

10

"School."  The Scranton State School for the Deaf.

11

Section 3.  Moratorium.

12

Notwithstanding any other provision of law and pending

13

submission to the General Assembly of the study required under

14

section 4, if a closure of the school is not made before June

15

30, 2009, a moratorium is established during which the school

16

may not undergo closure.

17

Section 4.  Study of operations and costs.

18

(a)  Study.--The committee shall conduct a study, in

19

consultation with school officials, experts and specialists in

20

the field of educating the deaf community, as well as with

21

representatives of the department, to do all of the following:

22

(1)  Identify all existing Federal, State and county

23

funding streams that fund the school.

24

(2)  Identify the fiscal impact to the Commonwealth if

25

the school remains open and operated by the Commonwealth.

26

(3)  Examine the efficiency of the school's operations.

27

(4)  Determine specific methods to produce a more cost-

28

effective operation of the school.

29

(5)  Examine the issues articulated in support of and in

30

opposition to the proposal to close the school.

(6)  Identify what cost savings would be realized by the

2

Commonwealth by implementing the department's proposal to

3

close the school.

4

(7)  Identify if the proposed funding to implement the

5

department's proposal is efficient and adequate to be

6

utilized to keep the school operational for the duration of

7

the moratorium established under section 3.

8

(8)  Identify methods on how the Commonwealth can best

9

continue providing fiscal support to the school.

10

(9)  Identify any other issues the committee deems

11

appropriate.

(b)  Final report.--The committee shall submit a final report

13

with recommendations to the President pro tempore of the Senate,

14

the Education Committee of the Senate, the Speaker of the House

15

of Representatives and the Education Committee of the House of

16

Representatives no later than May 1, 2010, for review and any

17

appropriate legislative action.

Section 5.  Action.

19

Any student that would be affected by the closure of the

20

school shall have the right to institute an action in equity to

21

enjoin any person from closing the school.

22

Section 20.  Effective date.

23

This act shall take effect immediately.
