                             SUMMARY

The following summary is not prepared by the sponsors of the
measure and is not a part of the body thereof subject to

brief statement of the essential features of the measure as
introduced.

  Urges Congress to propose amendment to United States
Constitution to allow Congress and states to regulate campaign
contributions and expenditures for federal and state elections,
respectively.

                         JOINT MEMORIAL
To the Senate and the House of Representatives of the United
  States of America, in Congress assembled:
  We, your memorialists, the Seventy-seventh Legislative Assembly
of the State of Oregon, in legislative session assembled,
respectfully represent as follows:
  Whereas the Supreme Court of the United States has held that
the First Amendment to the United States Constitution prevents
regulating election spending; and
  Whereas the Oregon Supreme Court has held that Article I,
section 8, of the Oregon Constitution, prohibits limiting
campaign contributions by law; and
  Whereas an amendment to the United States Constitution would
provide clear constitutional grounds for allowing legislative
authority to regulate money in elections; and
  Whereas an amendment to the United States Constitution as
described in this memorial would be valid for all intents and
purposes as part of the United States Constitution when ratified
by the legislatures of three-fourths of the several states within
seven years after the date of its submission for ratification;
and
  Whereas the proposed amendment shall provide that Congress may
regulate the raising and spending of money with respect to
federal elections and states may regulate the raising and
spending of money with respect to state elections; now,
therefore,
Be It Resolved by the Legislative Assembly of the State of
  Oregon:
  (1) By resolution of the legislatures of two-thirds of the
several states, the Congress of the United States of America is
respectfully urged to propose an amendment to the United States
Constitution to allow Congress to regulate the raising and
spending of money with respect to federal elections and to allow

states to regulate the raising and spending of money with respect
to state elections.
  (2) A copy of this memorial shall be sent to the Senate
Majority Leader and the Speaker of the House of Representatives
and to each member of the Oregon Congressional Delegation.
