                             SUMMARY

The following summary is not prepared by the sponsors of the
measure and is not a part of the body thereof subject to
consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure as
introduced.

  Directs Department of Transportation to adopt standards for
bicycle trailers designed for human passengers.
  Prohibits sale of bicycle trailers that do not meet standards
adopted by department.

                        A BILL FOR AN ACT
Relating to bicycle trailers.
Be It Enacted by the People of the State of Oregon:
  SECTION 1. { +  The Department of Transportation shall adopt
rules establishing minimum standards for bicycle trailers
designed for human passengers. The department shall consult the
ASTM International specification F1975-09, 'Standard
Specification for Nonpowered Bicycle Trailers Designed for Human
Passengers,' in forming its standards. The department may review
specifications adopted by ASTM International, or equivalent
organizations, and revise the standards adopted pursuant to this
section as necessary. + }
  SECTION 2.  { + (1) A person may not sell a bicycle trailer
designed for human passengers unless the bicycle trailer conforms
to the standards adopted by the Department of Transportation by
rule under section 1 of this 2011 Act.
  (2) In addition to any other remedy provided by law, an
individual who purchases a bicycle trailer that does not conform
to the standards adopted by the department may bring a civil
action to recover actual damages or $1,000, whichever is greater,
against the person that sold the bicycle trailer to the
individual. A court shall award a prevailing plaintiff reasonable
costs and attorney fees.
  (3) An action brought under this section shall be commenced
within two years from the date the individual purchased the
bicycle trailer. + }
  SECTION 3.  { + Sections 1 and 2 of this 2011 Act apply to
bicycle trailers designed for human passengers sold on or after
the effective date of this 2011 Act. + }
