                             SUMMARY

The following summary is not prepared by the sponsors of the
measure and is not a part of the body thereof subject to
consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure as
introduced.

  Authorizes Secretary of State to establish, maintain, enhance,
expand and add capacity to central business registry for
identified purposes.
  Declares emergency, effective on passage.

                        A BILL FOR AN ACT
Relating to the Secretary of State's business registry functions;
  amending ORS 56.022; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
  SECTION 1. ORS 56.022 is amended to read:
  56.022.  { + (1) + } The Secretary of State   { - shall
have - }  { +  has + } the power and authority reasonably
necessary to enable the Secretary of State to carry out business
registry functions and other duties imposed on the Secretary of
State under ORS chapters 58, 60, 62, 63, 65, 67, 70, 554, 647,
648 and 649 and ORS 128.560 to 128.600 and 661.210 to 661.280,
including the authority to { + :
  (a) + } Promulgate rules governing the procedure and form
for { + :
  (A) + } Submitting documents to be filed by the Secretary of
State { + ; + } and
   { +  (B) + }   { - the procedure and form for - }  Filing and
retaining the documents and any other records required to be
kept.
   { +  (b) Establish and maintain a central registry to carry
out the functions described in this section.
  (2) The Secretary of State may enhance, expand and add capacity
to the central registry described in subsection (1)(b) of this
section as necessary to:
  (a) Provide access to business registry functions and
information over the Internet and in a manner that best enables
members of the public to register and renew registrations for
business entities, to file documents and to obtain information
easily and efficiently;
  (b) Integrate the Secretary of State's business registry
functions with business registry functions that local
governments, municipalities and other public bodies, as defined
in ORS 174.109, perform under the authority of local ordinances
and regulations and with licensing functions that state agencies
perform under the laws of this state;

  (c) Validate and secure information entered into and stored in
the central registry; and
  (d) Otherwise improve, update and make the central registry
responsive to the needs of members of the public. + }
  SECTION 2.  { + This 2011 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2011 Act takes effect on its
passage. + }
